There's likely to be a fit issue to begin with. NiMH batteries have a very different charge profile than PbA, so the existing BMS will NOT work unless it can be reprogrammed. Changing battery chemistries can be done, but it's a lot of very careful and relatively technical work...

Sounds like a loose connection to me. At best the plug might be coming loose or the motor position encoder could be going bad. Worst case an IGBT module in the controller could be going bad, or there is a ground fault. if there is a ground fault the HV contactors should open?...
